Terms of Service

Last updated: October 12, 2026

1. Agreement

These Terms of Service govern your access to and use of OddShed, including the website, AI game builder, previews, project workspace, publishing tools, hosted games, support, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these terms in full.

If you use the Service on behalf of an organization, you confirm that you have authority to bind that organization and that the organization accepts these terms.

The Service is operated by OddShed. You can reach us at hello@oddshed.com.

2. Eligibility and Accounts

You must be 18 or older to create an account on OddShed. Anyone can play published games without an account. Do not use the Service if you are barred from doing so under applicable law.

  • Provide accurate, current, and complete account and contact information.
  • Keep your login credentials confidential and secure.
  • Notify us promptly at support@oddshed.com if you suspect unauthorized access to your account.
  • You are solely responsible for all activity that occurs under your account.

3. Game Builder and AI Output

OddShed helps you turn text prompts into playable video game drafts, code, audio, visual assets, previews, and project files using AI. AI-generated output may be incomplete, incorrect, non-unique, similar to content generated for others, or otherwise imperfect. You are solely responsible for testing, reviewing, and determining whether any output is appropriate to use, publish, export, distribute, or commercialize.

Do not submit passwords, API keys, private credentials, sensitive personal information, or third-party content unless you have the right to use it in this context. We may reject, disable, or remove prompts, projects, outputs, or published games that violate these terms or create legal, safety, security, intellectual property, or operational risk.

4. Your Content and License to Us

As between you and OddShed, you retain ownership of your prompts, project content, uploaded assets, and the games you create, subject to any rights held by third parties, applicable third-party licenses, provider terms, or open-source dependencies included in generated output.

You grant OddShed a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, transcode, modify for technical compatibility, generate previews and thumbnails from, display, transmit, cache, and otherwise use your content to the extent necessary to operate, improve, evaluate, benchmark, secure, debug, support, and develop the Service. This includes internal review of prompts, generated files, agent behavior, model routing, validation results, runtime/playtest results, cost, latency, and feedback so we can improve generation quality and reliability. If you publish a game, this license also permits us to display and make that game available to visitors you share it with or to public showcase surfaces where the game is eligible, including the OddShed game library.

We do not treat private raw projects, private conversations, or soft-launch tester traces as public benchmark material by default. Public benchmark posts, examples, or case studies must use aggregate data, redacted or anonymized material, published projects, or separately approved curated examples.

The AI agent that plans and builds your game runs on open-weight models on endpoints with zero data retention, which do not keep your private prompts, conversations, or project files and do not use them to train any model. Those model hosts still process request content and may retain limited security, billing, abuse-prevention, or operational metadata under their terms. Image generation providers (OpenAI GPT Image 2 and PixelLab) and our web search providers (Firecrawl and Parallel) handle the requests they receive under their own published terms, as the Privacy Policy describes. Provider routing and retention controls are separate from this product-improvement license.

5. Publishing, Sharing, and Takedowns

Projects are private by default unless you intentionally publish or share them. Every account can share a game through a play link. Listing a game in the Game Library needs an Explorer plan or higher, so on the free plan you share games by link. Publishing a game may make its title, description, thumbnail, generated runtime files, publisher handle, and gameplay publicly accessible. You can unpublish a game from your workspace, but exported copies, third-party links, search engine indexes, screenshots, caches, or files already saved by others may remain outside our control.

We may review, hide, remove, or restrict access to games or content that appear unlawful, infringing, deceptive, abusive, unsafe, malicious, exploitative, spammy, or otherwise harmful to users or the Service. We have no obligation to monitor content proactively but reserve the right to act on content that comes to our attention.

For copyright or intellectual property concerns, contact us at hello@oddshed.com with enough detail to identify the work, the allegedly infringing material, its location on the Service, your contact information, and a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law.

6. Acceptable Use and Content Rules

You agree not to make, publish, or share games or other content on the Service that:

  • Sexual content. Contains sexual, pornographic, or sexually explicit material of any kind. Any sexual content involving minors, or content that sexualizes or exploits children, is strictly forbidden. We report it to the authorities, including the National Center for Missing and Exploited Children (NCMEC) where required.
  • Real people. Depicts, mocks, targets, or impersonates a real, identifiable private person without their consent. This includes using someone's photo, name, or likeness in a game made to embarrass, harass, or harm them.
  • Hate and extremism. Promotes hatred or violence against people based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age. Also forbidden: glorifying or recruiting for real terrorist or violent extremist groups, or recreating real mass-violence attacks.
  • Harassment. Threatens, bullies, harasses, doxes, or stalks anyone, in a game, in multiplayer rooms, or anywhere else on the Service.
  • Dangerous instructions. Gives real-world instructions for weapons, explosives, illegal drugs, self-harm, or suicide, or encourages self-harm or eating disorders.
  • Scams and malicious code. Is or includes malware, ransomware, crypto mining, phishing pages, fake login or payment forms, hidden redirects, or code that collects other people's data without their clear consent.
  • Real-money gambling. Includes gambling with real money or anything of real-world value.
  • Deception and infringement. Infringes copyright, trademark, privacy, or other rights, or pretends to be OddShed, another company, or another creator.
  • Spam. Is spam, or floods the library, feeds, or rooms with repetitive or low-effort content.
  • Breaking the law. Breaks any law or regulation.

You also agree not to:

  • try to get around our safety filters or the AI's content rules, for example with jailbreak or prompt-injection techniques;
  • create multiple accounts to collect sign-up bonuses or referral rewards, or to return after a suspension;
  • probe, bypass, disable, or attack our security controls, rate limits, credit accounting, or access restrictions;
  • scrape, resell, or sublicense the Service or its models except through features we provide;
  • interfere with the Service's reliability, cost controls, billing, or normal operation.

How we enforce these rules. We may check prompts, uploads, and generated content automatically, and a person may review them. If you break these rules, we may do any of the following, depending on how serious it is:

  • refuse a request;
  • remove or hide content;
  • give you a warning;
  • limit features;
  • suspend or close your account;
  • forfeit credits;
  • report to law enforcement.

Serious violations, such as anything involving the sexual exploitation of children, lead to immediate account closure without warning.

You can report a game with its report button, or report a game or a player by email at support@oddshed.com. We may share necessary information with our AI providers and the authorities to prevent abuse.

7. Credits, Billing, and Payment

AI generation, asset creation, playtesting, and other compute-intensive features use credits. Code view, ZIP export, and GitHub export need an Explorer plan or higher. Credits are a service usage unit (not currency, a financial instrument, or a deposit) and do not guarantee any specific creative result.

  • Free sign-up credits: New accounts get a one-time grant of free credits, with no card required. The amount is shown when you sign up. These credits expire 90 days after they are granted. You can spend them at your own pace, with no daily limit, and they cannot be transferred.
  • Paid plans: Explorer, Pro, and Studio plans include a monthly credit allowance that resets each billing cycle, plus the plan features shown on the pricing page. Credits are specific to the plan period and do not roll over indefinitely; each cycle your balance resets to your plan limit.
  • Credit top-ups: Credit packs are a top-up for subscribers: you need an active paid plan to buy one. Pack credits are consumable digital goods, expire 12 months after purchase, and remain spendable until that expiry date, including after a subscription ends.
  • Merchant of Record: Polar Software, Inc. ("Polar") is our Merchant of Record and authorized reseller. Polar handles checkout, payment processing (through its own payment provider), billing, invoicing, tax, and refund disbursement on our behalf. By completing a purchase you also agree to Polar's terms of service and privacy policy. Your payment card details are collected and stored by Polar and its payment provider, not on our servers.
  • Automatic renewal: Paid subscriptions renew automatically at the end of each billing period at the then-current price, and charges recur until you cancel. You can cancel anytime through the customer portal that Polar links from your receipt emails. Cancellation takes effect at the end of the current billing period, and your access continues until then.
  • Taxes: Prices are in USD and may be subject to applicable VAT, sales tax, or other taxes added at checkout by Polar based on your location. Tax amounts are non-refundable.
  • Price changes: We may adjust pricing or credit allowances prospectively with reasonable notice. Your current billing cycle is not affected.

Refunds are governed by our Refund Policy, which is incorporated into these terms by reference.

8. Partner Program and Referrals

Partner or affiliate participation is available only after written approval. Submitting a partner application does not create payout rights, exclusivity, employment, agency, or authority to make commitments on behalf of OddShed.

Partners must market the Service truthfully, avoid spam and misleading claims, and clearly disclose any material relationship, including compensation, free access, or other incentives, in accordance with applicable advertising disclosure laws. We may reject, pause, reverse, or terminate referral credits for fraud, undisclosed promotions, coupon misuse, self-referrals, or traffic that creates security, billing, or reputation risk.

9. Third-Party Services

OddShed relies on third-party providers for hosting, databases, file storage, AI model inference, image generation, web search, email delivery, billing, logging, analytics, and other integrations. Your use of the Service may also be subject to the terms and privacy policies of these providers, including Lovable (hosting, sign-in, and account emails), Supabase (database), Polar (Merchant of Record and billing), and the AI providers we use for text, code, images, web search, and optional voice transcription. The Privacy Policy names the current providers. Sound effects and music come from our own library. The specific providers and models may change over time. We are not responsible for the acts or omissions of third-party services outside our reasonable control.

10. Open Source and Exported Code

Generated games, templates, and exported code may include open-source packages, third-party libraries, or other materials that carry their own license terms (for example, MIT, Apache 2.0, GPL). You are responsible for reviewing and complying with those license terms before publishing, distributing, selling, or modifying a game outside the OddShed platform.

11. Feedback

If you provide feedback, bug reports, feature requests, prompts, or suggestions about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose, including improving the Service, without restriction or compensation to you. Do not share feedback that you consider confidential or proprietary.

12. Suspension and Termination

We may suspend, restrict, or terminate your account or access to the Service at any time if we believe there is a material terms violation, legal or regulatory risk, security threat, payment failure, fraud, abuse, or operational necessity. Where practical and not legally or security-prohibited, we will provide notice and an opportunity to remedy the issue before termination.

You may stop using the Service at any time. You can delete your account in Settings, under Danger Zone. Everything is deleted within 30 days, and you can cancel the request until then; tax and billing records we must keep are anonymized and kept. For help, contact us at support@oddshed.com. On termination for any reason, your right to use the Service ceases immediately, unused credits are not redeemable for cash, and paid subscriptions are subject to the Refund Policy.

13. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind. To the fullest extent permitted by applicable law, OddShed expressly disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and error-free or uninterrupted operation. We do not warrant that a generated game will function correctly in all environments, be unique, be legally clear, be accepted by third-party app stores, or be commercially valuable.

14. Limitation of Liability

To the fullest extent permitted by applicable law, OddShed and its owners, operators, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, business interruption, device damage, or damages arising from third-party claims, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from or relating to the Service or these terms will not exceed the greater of (a) the total amounts you paid to us in the twelve months preceding the claim or (b) USD $50. This limitation applies regardless of the legal theory on which the claim is based.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless OddShed and its owners, operators, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) your use of the Service; (b) your content or games; (c) your violation of these terms; (d) your violation of any third-party rights, including intellectual property or privacy rights; or (e) your violation of any law or regulation. We reserve the right to assume exclusive defense of any matter subject to your indemnification obligation, in which case you agree to cooperate with our defense of that claim.

16. Dispute Resolution

Before initiating any formal dispute, you agree to contact us at support@oddshed.com and attempt to resolve the matter informally for at least 30 days. Most concerns are resolved quickly through support.

These terms and any disputes arising from them are governed by the laws of the jurisdiction where OddShed is organized, without regard to conflict-of-law rules. You agree that any dispute that cannot be resolved informally will be resolved exclusively by binding individual arbitration administered under the rules of a recognized arbitration body, except that either party may seek emergency injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

To the extent permitted by law, you waive the right to participate in any class action, collective, or representative proceeding against OddShed.

17. Changes

We may update these terms as the Service, pricing, integrations, legal landscape, or operations evolve. The date at the top shows the most recent update. We will provide reasonable advance notice of material changes (for example by email or in-app notification) where required by law or where the change materially affects your rights. Continued use of the Service after the effective date of an update constitutes your acceptance of the revised terms.

18. General

If any provision of these terms is found unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and OddShed with respect to the Service and supersede any prior agreements.
